Welcome to Notiq. These Terms of Service ("Terms") form a binding agreement between you and Notiq ("we", "us", "our") and govern your access to and use of the Notiq website, applications, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Notiq Does

Notiq turns publicly available YouTube videos into structured study notes, flashcards, practice questions, diagrams, and related study aids using automated and AI-assisted processing. The Service is intended for personal study, research, and educational use.

2. Eligibility & Accounts

  • You must be at least 16 years old (or the age of digital consent in your country) to use Notiq.
  • You are responsible for your account credentials and all activity under your account.
  • You agree to provide accurate information and to keep it up to date.
  • You must notify us promptly of any unauthorized use of your account.

3. Acceptable Use

You agree not to:

  • Use the Service to infringe the intellectual property or other rights of any third party.
  • Process content you do not have the right to access or use.
  • Resell, redistribute, or commercially exploit generated outputs in violation of the rights of the original content owners.
  • Attempt to disrupt, reverse-engineer, scrape, or overload the Service or its infrastructure.
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.

4. Third-Party Content & YouTube

Notiq processes videos hosted on YouTube and other third-party platforms. We do not own that content, and your use of it is subject to the terms of the relevant platform (including the YouTube Terms of Service). You are responsible for ensuring that your use of any video and the notes generated from it complies with the rights of the content owner and applicable copyright law. Generated notes are summaries created for personal study and do not reproduce the underlying video. Notiq is not affiliated with, endorsed by, or sponsored by YouTube or Google.

5. AI-Generated Output

Notes, summaries, flashcards, and diagrams are produced by automated systems and may contain errors, omissions, or inaccuracies. Output is provided "as is" for study assistance and should not be relied upon as authoritative, professional, medical, legal, or academic advice. Always verify important information against the original source. You are responsible for how you use generated output, including compliance with your institution's academic-integrity policies.

6. Plans, Billing & Refunds

  • Notiq offers free and paid plans. Paid plans are billed through our payment processor, Stripe.
  • Subscriptions renew automatically until cancelled. You can cancel at any time from your account; access continues until the end of the current billing period.
  • Except where required by law, fees are non-refundable. EU/UK consumers may have statutory withdrawal rights as described at checkout.
  • We may change pricing with reasonable notice; changes apply to subsequent billing periods.

7. Your Content

You retain ownership of the links you submit and any notes you edit. You grant us a limited license to process and store this content solely to operate and improve the Service. We do not sell your content.

8. Intellectual Property

The Service, including its software, design, branding, and original blog content, is owned by Notiq and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding without prior written permission.

9. Service Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Processing depends on third-party services (such as video platforms and AI providers) that may change or become unavailable. We may modify, suspend, or discontinue features at any time.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Notiq will not be liable for any indirect, incidental, consequential, or special damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

12. Termination

We may suspend or terminate your access if you violate these Terms or use the Service in a way that creates risk or legal exposure for us or others. You may stop using the Service and delete your account at any time.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Continued use after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of Romania and the European Union, without regard to conflict-of-law rules. Mandatory consumer-protection rights in your country of residence still apply.
